Terms & Conditions

In short: Jet Club Charter is a charter broker. We arrange flights on your behalf with independent, licensed air operators. We do not own or operate aircraft, and the operator — not Jet Club Charter — is the carrier responsible for your flight.

1. Who we are

These terms apply to every enquiry, quote and booking made with Jet Club Charter (“Jet Club”, “we”, “us”, “our”), 74 Indrì Vella Street, Pembroke PBK 1314, Malta. Email info@jetclubcharter.com, telephone/WhatsApp +356 7783 6902.

“You” means the person who requests a quote or makes a booking, and, where relevant, everyone travelling under that booking. If you book for others or for a company, you confirm you are authorised to accept these terms on their behalf and are responsible for making sure they comply with them.

2. Our role as broker

  • We act as agent for you, the client, in arranging the charter of an aircraft from an air operator. We do not act as an air carrier, and we do not own, operate, crew or maintain aircraft.
  • Every flight is operated by an air operator holding a valid Air Operator Certificate (AOC) and operating licence (the “Operator”). The Operator is named in your quote and Charter Confirmation.
  • Your contract of carriage is with the Operator, and the Operator’s own terms and conditions of carriage apply to your flight in addition to these terms. If the two conflict on anything to do with the flight itself, the Operator’s terms prevail. We will give you a copy on request.
  • The Operator has sole operational control of the aircraft at all times, including decisions on safety, routing, weather, fuel, loading, passengers and baggage. The captain’s decision is final.
  • We may receive a commission or margin from the Operator or include our service fee in the price we quote you. The price quoted is the total price you pay.

3. Quotes

  • Quotes are based on the information you give us (route, dates, times, passengers, baggage, special requirements) and on the Operator’s availability and pricing at the time.
  • A quote is an invitation to book, not a guarantee of availability. Aircraft are only reserved once a booking is confirmed under clause 4.
  • Unless stated otherwise, quotes are valid for 24 hours or until the aircraft is booked by someone else, whichever is sooner.
  • Each quote states what is included. Unless listed as included, extras such as de-icing, special catering, additional crew, ground transport, overnight crew costs, extended waiting time, hangarage and changes you request will be charged at cost.
  • Aircraft photos on our website are illustrative and may not show the specific aircraft you fly.

4. Booking and payment

  • A booking is confirmed only when (a) you sign or accept in writing the Charter Agreement / Charter Confirmation we send you, and (b) we receive payment in full, in cleared funds, by the deadline stated. Until both have happened, the aircraft is not secured.
  • Unless your Charter Confirmation says otherwise, payment is due in full on booking. For bookings made at short notice, payment must be received before departure.
  • If payment is not received by the deadline, we and the Operator may cancel the booking and the cancellation charges in clause 6 apply.
  • Payments can be made by bank transfer or card. Bank and card charges are your responsibility. Prices are quoted in euro unless stated otherwise.
  • Where you pay us, we receive the money as your agent for onward payment to the Operator and other suppliers.

5. Price changes

Once a booking is confirmed, the price is fixed except for increases outside our and the Operator’s control that arise after confirmation and that we will show to you in writing, such as new or increased government taxes, airport, navigation or security charges, or costs caused by changes you request. We will not increase the price because of ordinary fuel price movement after confirmation unless your Charter Confirmation specifically allows it.

6. Changes and cancellation by you

  • Changes to times, routes or passengers must be requested in writing and are subject to the Operator’s agreement and any extra cost.
  • Cancellations must be made in writing (email or WhatsApp to us). The cancellation charges set out in your Charter Confirmation apply. If none are stated there, the following charges apply as a percentage of the total charter price:

Any costs already incurred and not refundable to us (for example catering, ground transport or permits) are also payable.

7. Empty legs

Empty-leg (one-way repositioning) flights depend on the Operator’s original booking. Their date, time and route may change, and the Operator may cancel them at short notice. If an empty leg you booked is cancelled by the Operator, you will receive a full refund of the price paid for that leg, or we will try to offer an alternative at the usual charter price. We are not liable for any further cost or loss caused by such a change or cancellation, so please do not book empty legs where your onward plans cannot accommodate changes.

8. Delays, substitutions and Operator cancellation

  • Departure times are estimates. Flights may be delayed, diverted or cancelled for reasons including weather, air traffic control, airport restrictions, crew duty limits, technical issues or safety concerns.
  • If the booked aircraft becomes unavailable, the Operator or we may substitute an aircraft of similar or higher category. If the substitute is of a lower category, you will be refunded the price difference or may choose to cancel and receive a refund of the price paid for the affected flight.
  • If the Operator cancels a flight and no reasonable substitute is available, you will receive a full refund of the price paid for that flight. Your rights against the Operator under applicable law (including where relevant Regulation (EC) No 261/2004 and the Montreal Convention) are not affected.

9. Passengers, documents and baggage

  • You must give us accurate passenger details (full names as in passports, dates of birth, nationalities, document numbers) by the deadline we set. The Operator and authorities need these by law.
  • Each passenger is responsible for holding valid passports, visas, health documents and any permits for every country visited. We and the Operator are not liable if a passenger is refused travel or entry for lack of correct documents.
  • Baggage must fit the aircraft’s limits stated in your quote. The Operator may refuse excess or oversized baggage. Dangerous goods and prohibited items may not be carried.
  • Pets travel only with the Operator’s prior agreement and with the correct documents.
  • The captain may refuse to carry anyone who appears unfit to fly, under the influence of alcohol or drugs, behaves in a way that may endanger the aircraft or others, or does not comply with crew instructions. No refund is due in that case. You are responsible for any damage to the aircraft caused by you or your party, including cleaning costs beyond normal use. Smoking (including e-cigarettes) is not permitted unless the Operator expressly allows it.
  • Please arrive at the terminal or FBO at least 30 minutes before departure. Late arrival may lead to delay charges or loss of slot.

10. Liability

  • The Operator is responsible for the flight. As the carrier, the Operator is responsible for the safe performance of the flight and for death, injury, delay, and loss of or damage to baggage, in accordance with its conditions of carriage and applicable law, including the Montreal Convention and Regulation (EC) No 2027/97. Operators must hold insurance under Regulation (EC) No 785/2004.
  • We are not liable for the Operator’s acts or omissions, or those of airports, handling agents, caterers, ground-transport providers or other third parties, including delays, diversions, cancellations, technical problems, or the condition, crew or performance of the aircraft.
  • Our own responsibility is to arrange your booking with reasonable care and skill. To the fullest extent permitted by law, our total liability to you for any claim connected with a booking, whether in contract, tort (including negligence) or otherwise, is limited to the total price you paid for the affected booking.
  • We are not liable for indirect or consequential loss, or for loss of profit, business, contracts, opportunity, enjoyment or connecting travel, or for the cost of missed events or onward arrangements.
  • Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under Maltese or EU law. If you are a consumer, your statutory rights are not affected.
  • We strongly recommend that every passenger takes out comprehensive travel insurance, including cancellation cover.
  • We do not sell package travel. If, at your request, we arrange other travel services alongside a flight (such as transfers or accommodation), each is a separate contract with that supplier unless we tell you in writing that it is a package.

11. Force majeure

Neither we nor the Operator are liable for failure or delay caused by events beyond reasonable control, including extreme weather, natural disasters, war, terrorism, civil unrest, strikes, airspace or airport closures, government action, epidemics, or failures of air traffic control or third-party systems. If a flight cannot operate for such a reason, any refund will follow the Operator’s terms and clause 8.

12. Complaints

If something goes wrong, please tell us as soon as possible, and in writing within 28 days of the flight, at info@jetclubcharter.com. We will pass on any complaint about the flight to the Operator and help you resolve it. Claims for damaged or lost baggage must be made to the Operator within the time limits in the Montreal Convention (7 days for damage, 21 days for delay).

13. Use of this website

Information on this website is for general guidance and may change without notice. Flight times, ranges and capacities are approximate. We try to keep the website accurate and available but do not guarantee it. Website content, logos and images are owned by or licensed to us and may not be copied without permission. Our handling of personal data is described in our Privacy Policy and Cookie Policy.

14. Governing law and jurisdiction

These terms are governed by the laws of Malta. The courts of Malta have jurisdiction over any dispute. If you are a consumer living in another EU country, you also keep the protection of the mandatory laws of that country and may bring proceedings there. If any part of these terms is found invalid, the rest remains in force. We may update these terms from time to time; the version in force when you book applies to your booking.
